Capital Gains Tax (CGT) is charged at the rate of 25% on the capital gains derived from the disposal or sale of a chargeable asset. The Buyer should deduct CGT from the proceeds made to the Seller for a sale of a Chargeable Asset.
Import Taxes include Import or Customs Duty determined by the rate specified in the Harmonised System (HS Code) as per the Customs Tariff Act 1978, Import Withholding Tax at the rate of 5% in line with Section 114 of Income Tax Act 2000 as amended, ECOWAS Levy of 0.5%, Import GST (where applicable) at 15%, and Excise Duty (where applicable). The value of the Cost, Insurance, and Freight (CIF) is crucial in calculating Import Taxes.
Pay As You Earn (PAYE) is Personal Income Tax (PIT) paid by employees of organisations. The PAYE tax calculation for residents for tax purposes is determined by rates specified by the First Schedule of the Income Tax Act 2000 as amended, with a maximum rate of 35%. Employers are obligated to withhold the PAYE tax and pay to the National Revenue Authority by the 15th of the month following the month for which the tax was deducted.
In line with Section 120 of the Income Tax Act 2000 as amended, a Tenant is obligated to deduct Rent Tax from the rent paid to the Landlord. Although the Tenant withholds the tax, the incidence of the tax is on the Landlord. For individual Landlords, the Rent Tax withholding rate is 10% after deducting the non-taxable threshold and the maintenance allowance. For companies that are Landlords, the Rent Tax withholding rate is 10%, without deductions.
